Terms & Conditions

These Terms and Conditions (“Terms”) apply to Learn-to-Swim group lessons and related activities provided by Bluefin Watersports Sdn Bhd (“Bluefin”, “we”, “us”, “our”). By ticking “I accept the Terms & Conditions” at checkout and completing payment, you (the Parent/Guardian, “you”) agree to be bound by these Terms.

1. Booking, Payment & Scheduling

1.1 By purchasing a Bluefin activity, you agree to pay the required fees for the services provided by Bluefin Watersports Sdn Bhd. All payments are processed securely through our payment gateway.

1.2 You must confirm your set weekly session schedule with the Bluefin team. If your schedule is not secured, your child may be unable to participate — so that safe student-to-coach ratios are maintained — or the session may not proceed, as the coach may be unaware of your intended attendance.

1.3 Learn-to-Swim group subscriptions include one (1) session per week. Bluefin does not hold sessions on national public holidays; even allowing for these scheduled closures, the programme still averages more than four sessions per month across the year.

1.4 Subscriptions are billed monthly in advance and renew automatically each month until cancelled in accordance with clause 5.

1.5 Registration fee. New joiners pay a one-off registration fee of RM90, which includes the Bluefin welcome pack (currently a Bluefin swim cap and towel). Existing Bluefin swimmers may optionally pay the registration fee to receive the welcome pack. The registration fee is non-refundable.

2. Age & Eligibility

2.1 Activities are designed for specific age groups (children and adults). It is the parent’s/guardian’s responsibility to ensure the Participant meets the minimum age requirement for the chosen activity. Age limits are set for safety reasons, and we reserve the right to decline participation if they are not met.

3. Health, Safety & Behaviour

3.1 Health & fitness. You certify that the Participant is in good health and physically fit to take part in watersport activities. You agree to inform us in advance of any pre-existing medical condition or physical limitation. A doctor’s note may be required for certain activities.

3.2 Supervision & conduct. You are responsible for ensuring the Participant follows all safety instructions and poolside rules given by our staff. Failure to follow safety rules, or disruptive behaviour, may result in the Participant being removed from the activity without a refund.

3.3 Child safety & safeguarding. Bluefin is committed to safeguarding the welfare of every child in our care. Our Safeguarding Policy is available on request.

4. Fees, Cancellations & Refunds

4.1 Fees are non-refundable. All fees are non-refundable once paid, including where the Participant does not attend, withdraws, or is removed for breach of these Terms.

4.2 Rescheduling & make-ups by you. If you cannot attend a session, notify the Bluefin team at least 24 hours in advance. With such notice, you may take a make-up in another available session, provided it is completed within the same calendar month. Make-ups cannot be carried into a following month and have no cash value.

4.3 No-show / late cancellation. Sessions cancelled with less than 24 hours’ notice, or missed without notice, are forfeited and are not eligible for a make-up.

4.4 Weather. In the event of unfavourable weather (e.g., lightning storms), we reserve the right to move to covered pool space, switch to a dry-land activity, or cancel the session for safety reasons. Where we cancel a session, we will announce a replacement on the next available day, or you are welcome to join another available session in the Bluefin schedule within the same month.

4.5 Public holidays. Bluefin is closed on national public holidays, and no session runs on these dates. This is a scheduled closure, not a cancellation — it's built into our annual calendar and reflected in our subscription pricing, so no make-up is owed for a public holiday closure.

5. Subscriptions — Renewal & Cancellation

5.1 Subscriptions renew automatically each month until cancelled.

5.2 To cancel, notify us in writing at contact@bluefin-watersports.com before your next billing date. Your subscription remains active until the end of the current paid month, and no further payments will be taken from the next billing cycle. Fees already paid are non-refundable (clause 4.1).

6. Photographs & Media

6.1 By accepting these Terms, you give Bluefin Watersports Sdn Bhd permission to take photographs or videos of the Participant during activities, and to use appropriate images for promotional purposes, including on our website, social media and other marketing materials.

6.2 If you do not wish for your child to appear in any media, please inform us in writing at contact@bluefin-watersports.com at any time. From that point we will not use new images of your child.

7. Personal Data & Privacy (PDPA)

7.1 Bluefin Watersports Sdn Bhd collects and processes personal data — including the Participant’s name, age, contact details and any health information you provide — to deliver lessons, manage bookings and payments, ensure safety, and communicate with you.

7.2 We keep your personal data confidential. We do not sell or share your personal data with third parties for marketing or their own purposes. We disclose data only where strictly necessary to operate our service (for example, to our payment provider to process your payment) or where required by law. We process personal data in accordance with the Personal Data Protection Act 2010 (Malaysia) and retain it only for as long as necessary to provide our services and meet our legal obligations.

7.3 You may request access to or correction of your personal data, or ask how it is used, by contacting contact@bluefin-watersports.com.

8. Governing Law

8.1 These Terms are governed by the laws of Malaysia, and any disputes arising from them will be subject to the jurisdiction of the Malaysian courts.

9. Changes to these Terms

9.1 We may update these Terms from time to time. The current version and its effective date are published on our website. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.

10. Acknowledgment & Agreement

By ticking “I accept the Terms & Conditions” at checkout and completing payment, you confirm that you have read, understood and agree to be bound by these Terms, and that you are the Participant or the legal parent/guardian of the Participant with authority to make decisions on their behalf.
