Bluefin Participant Terms & Conditions

1. General Terms
1.1.a) Booking and Payment
By purchasing a Bluefin Watersports activity, you agree to pay the required fees for the services
provided by Bluefin Watersports Sdn Bhd. All payments are processed securely through our
payment gateway. Upon purchasing a plan, you acknowledge that you must inform the Bluefin
team of your set weekly schedule. Failure to secure your session schedule may result in your
child not being allowed to participate due to student:coach rations, or the session not going
ahead due to the coach not being aware of your intention to attend.
b) Learn To Swim group subscriptions are 1 session per week only.
c) Swim Team subscriptions are dependent on the package purchased, with either 1, 2, 3, or 4
sessions available each week.
1.2. Age and Eligibility
Activities are designed for specific age groups (children and adults). It is the parents
responsibility to ensure that the Participant meets the minimum age requirements for the activity
chosen. Age restrictions are set for safety reasons, and we reserve the right to deny
participation if the age requirements are not met.
1.3. Waiver of Liability
You, as the Parent/Guardian, understand and accept the inherent risks associated with
watersport activities, including but not limited to drowning, injury, or accidents. You agree to hold
Bluefin Watersports Sdn Bhd and its employees harmless from any liability resulting from these
risks, except in cases of gross negligence or misconduct. Furthermore, you, as Parent/Guardian
agree to hold Bluefin Watersports Sdn Bhd, and its employees, harmless from any liability
resulting in loss or damage to personal belongings.

2. Safety and Medical Information
2.1. Health and Fitness
You certify that the Participant is in good health and physically fit to engage in watersport
activities. If the Participant has any pre-existing medical conditions or physical limitations, you
agree to inform us in advance. For certain activities, a doctor's note may be required.
2.2. Supervision and Behavior
The Parent/Guardian is responsible for ensuring that the Participant follows all safety
instructions given by our staff, and poolside rules. You understand that failure to comply with
safety rules or disruptive behavior may result in the Participant being removed from the activity
without a refund.

3. Cancellations, Changes, and Refunds
3.1. Cancellation Policy
If you need to cancel or reschedule your booking, you are to notify the Bluefin team at least
24hrs in advance. Cancellations made within 24hrs of the activity are subject to a forfeit of the
payment.
3.2. Weather Conditions
In the event of unfavorable weather conditions (e.g., lightning storms), we reserve the right to
move to the covered pool space, change to dry-land activity, or cancel the activity for safety
reasons. In cancellation cases, a rescheduling option will be available to participants during one
of the alternative scheduled group sessions, and rescheduled within the term date or booking
month. Lessons will not be refunded under these circumstances.
3.3. No-Show Policy
Failure to attend the scheduled activity without prior notice will result in a forfeiture of the
booking fee.
3.4 Holidays
Bluefin Watersports may cancel sessions due to government holidays. In the event of sessions
being cancelled due to this reason, sessions will not be replaced nor the value be refunded, but
customers are welcome to reschedule to one of the other available classes in the bluefin
schedule.

4. Photographs and Media
4.1. Media Consent
By agreeing to these terms, you give Bluefin Watersports Sdn Bhd permission to take
photographs or videos of the Participant during the activity. Appropriate photos may be used for
promotional purposes, including on our website, social media, and other marketing materials. If
you do not wish for your child to appear in any media, please inform us in writing prior to the
activity.

5. Governing Law
5.1. Jurisdiction
These Terms and Conditions shall be governed by the laws of Malaysia, and any disputes
arising from the Terms will be resolved in the courts of Malaysia Jurisdiction.

6. Acknowledgment and Agreement
By proceeding with booking and payment, you acknowledge that you have read, understood,
and agree to be bound by the Terms and Conditions outlined above. You also confirm that you
are the participant, or legal parent or guardian of the Participant and have the authority to make
decisions on their behalf.
